Terms of Service
Last updated September 30, 2026
Plain-language summary. House Into Cash is the company in the middle. It puts each property under contract as the principal buyer, then assigns that contract to the investor who wins a competitive auction. It is not a broker or agent, and this is not a peer-to-peer sale. No money moves through this platform. Every winning offer is subject to the seller’s review and approval, and the as-is and after-repair figures shown are estimates, not appraisals or guarantees.
These Terms of Service (the “Terms”) are a binding agreement between you and KEY WEALTH PACIFIC LLC, a California limited liability company, doing business as House Into Cash (“House Into Cash,” “we,” “us”). They govern your use of the House Into Cash Marketplace at houseintocash.com and its subdomains (the “Service”). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. Who we are
House Into Cash acts solely as a principal contracting party for its own account. It puts a property under an assignable purchase agreement signed by the seller, then assigns that contract to a vetted investor for a disclosed fee. House Into Cash renders no brokerage or agency services to anyone and does not represent either the seller or the investor. The consideration it receives is for the transfer of contract rights, not compensation for services performed for another person. Escrow and closing are handled by a separate, licensed escrow company.
2. How the marketplace works
- A seller lists a property and signs an assignable purchase agreement with House Into Cash before the listing goes live.
- The listing is offered to verified investors in a timed, competitive auction with a confidential reserve the seller sets.
- A winning bid at or above the reserve is subject to the seller’s written approval. Nothing sells without the seller’s consent.
- House Into Cash assigns the purchase agreement to the winning investor, who closes directly with the seller through a licensed escrow company.
Where these Terms conflict with a signed transaction document (for example the purchase agreement, the assignment agreement, or the investor non-disclosure and non-circumvent agreement), that signed document controls for that transaction.
3. Eligibility and accounts
You must be at least 18 years old and able to enter into a binding contract. You are responsible for the accuracy of the information you provide and for keeping your login credentials secure. Accounts are individual to a role (seller, investor, or administrator); you may not share access or misrepresent your identity, authority to sell, or ability to purchase.
You may delete your account at any time from Account settings, unless a signed agreement or an auction is still open on it; in that case the page tells you what is open and how it can end. Deleting your account does not cancel or change any agreement you have signed. Our Privacy Policy explains what is deleted and what we keep.
4. Sellers
You represent that you own the property or are authorized to sell it, and that the information and disclosures you provide are true and complete to the best of your knowledge. Listing is free and carries no obligation. You may cancel at no cost any time before the auction closes. You set a confidential reserve, and no sale is binding on you unless you approve the winning offer in writing. If a notice of default or notice of trustee’s sale is recorded against your home and you live in it, you sign a version of the purchase agreement written for that situation under California Civil Code sections 1695 through 1695.17: your minimum price is written into it as the guaranteed floor, you keep every dollar the winning bid goes above it, and you may cancel for any reason within five business days after you sign, using the Notice of Cancellation attached to it. Bidding cannot close before that period ends. House Into Cash performs no services for you before or after the sale and does not contact your lender or postpone a foreclosure sale. Escrow must close before the sale date.
5. Investors
Registered investors see city-level information only. Full street addresses and underwriting detail unlock, and bidding becomes available, only after you have both signed the investor non-disclosure and non-circumvent agreement and had your proof of funds approved. You agree to keep confidential information confidential, not to circumvent House Into Cash to contact a seller directly, and to honor the terms of any assignment agreement you sign, including the deposit and closing windows stated in that document. Bids are commitments, subject to the auction rules disclosed on each listing.
Bidding is direct. The amount you enter is your full bid, and it is binding once you place it. Nothing bids automatically, and there are no maximum bids: no bid is held as a hidden amount or raised for you. Each bid has to be at least the minimum shown on the listing. You may not bid more than you can close on. If a bid is entered in error, House Into Cash may void it. If your bid wins, the assignment consideration shown on the listing is added on top of it.
6. No investment, legal, or tax advice
The Service provides a marketplace and transaction tools. It does not provide investment, legal, financial, or tax advice, and nothing on it is a recommendation to buy or sell any property. Values, returns, and repair scopes are not guaranteed. You are responsible for your own due diligence and should consult your own professional advisors before making a decision.
7. Estimates and property information
As-is values, comparable sales, and after-repair value (ARV) figures are estimates generated from third-party data and automated models. They are not appraisals, guarantees, or promises of value, condition, or profit. Property descriptions come from sellers and public records and may be incomplete or inaccurate. Investors buy as-is and are responsible for verifying condition, title, and value independently.
8. No funds on the platform
House Into Cash does not collect, hold, process, or disburse any purchase funds, deposits, or proceeds through the Service. The winning investor’s non-refundable deposit is paid directly to a licensed escrow company, and escrow disburses the seller’s proceeds at closing. House Into Cash is never a party to the movement of those funds.
9. Electronic signatures
Agreements offered through the Service may be signed electronically. By signing electronically you consent to do so under the federal ESIGN Act (15 U.S.C. §7001 et seq.) and applicable state law, including California’s Uniform Electronic Transactions Act (Civil Code §1633.1 et seq.). You may request a paper copy at no charge, or withdraw your consent for future documents, by emailing support@houseintocash.com. Withdrawing consent does not affect the validity of anything already signed.
10. Email and text messages
We send email and text messages about your account and transactions (for example bid, deadline, and approval alerts). Deals on the Service are coordinated this way, so agreeing to be contacted by phone, text, and email about your own property and transactions is part of creating an account. We do not send marketing messages. Message and data rates may apply, and message frequency varies. You can stop texts at any time by replying STOP or in Account settings, and resume by replying START; with texts off, we email you anything you need to sign. See our Privacy Policy for how we handle your contact information.
11. Your content and fair housing
You keep ownership of the listing text, photos, and other content you submit, and you grant House Into Cash a license to host, display, and use it to operate and market the Service. You are responsible for what you submit. Listing content must comply with the federal Fair Housing Act and all fair-housing laws: it must describe the property, not any preference, limitation, or discrimination based on race, color, religion, national origin, sex, familial status, or disability. We screen listing copy for likely fair-housing issues and may edit, hold for review, or decline to publish content that appears non-compliant.
12. Acceptable use
You agree not to:
- provide false, misleading, or fraudulent information;
- infringe anyone’s rights or violate any law, including fair-housing and consumer-protection laws;
- circumvent the access tiers, the auction rules, or the confidentiality and non-circumvent obligations;
- attempt to access accounts or data that are not yours, or probe, scrape, or disrupt the Service; or
- use the Service to harass any person, including a distressed seller.
We may suspend or terminate access that violates these Terms or that we reasonably believe poses a risk to users or the Service.
13. Disclaimers and limits
The Service is provided “as is” and “as available,” without warranties of any kind, express or implied, to the fullest extent permitted by law. We do not warrant that any listing, estimate, or transaction will meet your expectations or be error-free. To the fullest extent permitted by law, House Into Cashand its members and managers are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, arising out of your use of the Service. You agree to indemnify House Into Cash against claims arising from your content, your transactions, or your breach of these Terms. Nothing here limits liability that cannot be limited by law.
14. Governing law
These Terms are governed by the laws of the State of California, without regard to its conflict-of-law rules. The exclusive venue for disputes is the state and federal courts located in California, and you consent to their jurisdiction. Signed transaction documents may contain their own governing-law and dispute terms, which control for those documents.
15. Changes and contact
We may update these Terms from time to time. Material changes will be posted here with a new “last updated” date, and your continued use after a change means you accept the updated Terms. Questions? Contact us:
